These Terms of Service ("Terms") govern your use of aquasenseservices.com (the "Site") and the pool services provided by Aquasense Services LLC ("AquaSense," "we," "us," or "our"). By using our Site or services, you agree to these Terms. If you do not agree, please do not use our Site or services.

Our Services

AquaSense provides weekly pool maintenance and related pool services to residential customers in the Tucson, Arizona metropolitan area. The specific services we provide to you are described in the quote and service arrangement we agree to with you.

Quotes and Pricing

Pricing is based on an assessment of your pool, equipment, and conditions, and is provided to you in a quote. Pricing may vary based on pool size, equipment, condition, and the level of service required. We will communicate pricing to you before service begins. Pricing may be adjusted with advance notice.

Payment

Payment terms are as set out in your service arrangement. Invoicing and payment processing are handled through our third-party billing and payment software. You are responsible for keeping your payment information current and for paying amounts owed for services provided.

Cancellation

You may cancel your service at any time. There are no long-term contracts. Cancellation does not relieve you of responsibility for amounts owed for services already provided.

Property Access and Customer Responsibilities

To provide service, we need safe and reliable access to your pool area. By scheduling service, you authorize us to enter your property to perform the agreed services. You agree to:

• Provide accurate access information, including gate codes, lock combinations, or other access details
• Keep the path to the pool area reasonably clear and safe
• Secure or restrain pets during service visits
• Inform us of any hazards, special conditions, or equipment we should be aware of
• Maintain your pool equipment in safe, working condition

You are responsible for the accuracy of the access information you provide. We are not responsible for an inability to perform service caused by lack of access, locked gates, unsecured pets, unsafe conditions, or other circumstances outside our control.

Photographs and Service Records

As part of providing service, we may take photographs of your pool and service area for documentation, communication, and quality purposes, and we maintain service records. By using our services, you consent to our taking and retaining such photographs and records in connection with your service.

Service Conditions and Limitations

Pool conditions are affected by weather, usage, environmental factors, equipment condition, and other circumstances. Following severe weather such as monsoons or dust storms, service may be delayed and additional work may be required to restore your pool. We will make reasonable efforts to maintain your pool, but we do not guarantee specific water chemistry results, equipment performance, or freedom from algae, staining, or other conditions, particularly where these result from factors outside our reasonable control, including pre-existing equipment problems, weather, or how the pool is used between visits.

Communications

If you provide your phone number and opt in, you may receive text messages from us as described in our Privacy Policy. You can opt out of marketing messages at any time by replying STOP.

Disclaimers

Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or will achieve any particular result.

Limitation of Liability

To the fullest extent permitted by Arizona law, AquaSense and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of use, arising out of or related to our services or your use of the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or related to our services will not exceed the amount you paid us for services in the three (3) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless AquaSense and its owners, employees, and agents from any claims, damages, losses, or expenses arising out of your breach of these Terms, your violation of any law, or your provision of inaccurate access or property information.

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the state and federal courts located in Pima County, Arizona.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of our Site or services after changes are posted constitutes acceptance of the updated Terms.
